Buyers are Required to Conduct Their Own Due Diligence Prior to Purchase

We strongly encourage all buyers to conduct and on-site property before making a purchase whenever possible and to conduct any and all research necessary to determine the properties suitability for its intended purpose prior to making a purchase.

The information that we provide on this site is believed to be accurate to the best of our abilities however we do not guarantee its accuracy and it is the obligation of the buyer to do their own due diligence, verify any and all information, and to ask any and all questions before making a purchase.

Buyer(s) agrees that upon entering the purchase process that they have physically inspected and/or fully investigated the suitability of the parcel, including the availability of utilities, water, sewage, means of access, and zoning requirements. We will not be held liable for any allowance, adjustment or revision based upon the failure of the property to conform to any specific standards or for any inaccuracies in the information we have provided.

365 Day Land Exchange Policy

Buyers who have purchased their property using our guaranteed financing will be allowed a full year from the purchase of the property to switch properties and transfer their equity to another property from our available inventory at that time. We understand that many of our buyers do not have the opportunity to visit the property prior to making their purchase and we never want you to feel locked in which is why we allow you the opportunity to choose another. If you decide the property you purchased isn’t right for you, no problem, we’ll help you get setup with another one, all free of charge.

Exception to Our Exchange Policy

The exchange policy doesn’t apply to properties that have already been deeded or transferred into the buyer’s name(s). Due to the complexity, cost, and time of multiple property transfers we cannot make exchanges after the property has been transferred into the buyer’s name(s).

* Equity refers to payments applied towards principal and doesn’t include, interest payments, tax payments, dues, closing costs, or any other fees related to property ownership.

Buyers are allowed one free property exchange within 1 year of the purchase date. Additional transfers or transfers made after 1 year from the purchase date are subject to a $500 transfer fee and will only be made at the seller’s discretion.

We Guarantee Clear Title

We guarantee marketable title to all of our properties. We guarantee that all of our properties come free and clear of back dues, back taxes, liens, or mortgages on the property. If defects to the title are discovered we the seller will work to resolve such issues and shall be allowed ample time to remedy any title issues before other options are considered.

If we aren’t able to resolve a title issue a full refund will be granted to the buyer(s) and the buyer(s) will receive a credit of 10% towards the future purchase price of another of our available properties as a bonus for the inconvenience.

Pictures of the Properties

All of our pictures “of the actual property” are believed to the best of our ability to be accurate in their representation of the property and to have been taken on the property itself, however we offer no guarantees regarding their accuracy and the location at which the photographs were taken. It is strongly encouraged that the buyer(s) physically inspect the property prior to making a purchase and the photographs provide on this site are not intended to take the place of an on-site inspection of the property.

Guaranteed Access

We guarantee legal access to our properties for sale on Landzilla.com. Legal access refers to recorded legal access, which may or may not include physical road access. Legal access may also refer to easement access in which case access has been conveyed by deed and does not refer to physical access, which may not exist. Due to the ever changing conditions of roads we cannot and do not guarantee physical access. If access only exists by easement and physical access doesn’t currently exist that information will be available and will be noted in the parcel description or property data section.

Purchasing Land from this Website

In order to complete a purchase on this website buyer(s) must agree to comply with the terms and covenants set forth in our land sales agreement. The terms of the agreement require payments be made based on the finance terms agreed upon by both buyer(s) and seller at the time of the sale. The agreement also requires compliance with the covenants regarding land use stated in the agreement. Sample agreements will be made available upon request.

Buyer(s) have 72 hours from when the purchase is made to make their down payments and pay any closing costs. Payments sent by mail will require proof of shipment be provided to us within 72 hours of the purchase being made.

Buyer(s) have 10 days after the sale date to return their signed and completed land purchase agreements.

If payments or proof of shipment of payment are not received within 72 hours and/ or agreements are not returned within 10 days after the date of purchase we the seller have the right to cancel the agreement and re-list the property for sale.

Making Monthly Installment Payments

Monthly installment payments can be made by check, cashier’s check, money order, credit card, and debit card. Automated billing is available by credit card, debt card, or automated withdraw for a checking account. We do not accept cash or any other form of payment not listed above.

PLEASE NOTE: A $6.00 Monthly Payment Processing Fee is included in each monthly installment payment. This fee covers expenses associated with finance and account services.

Late Payments and Delinquent Accounts

Payments will be considered late 5 days after their due date. After ten days a late charge of 10% of the gross monthly payment, but not less than $10, will be charged and added to the delinquent account.

Account holders with payments later than 10 days will be issued late notices and will continue to be issued late notices until the account is brought current. Failure to respond to multiple late notices, and/or multiple missed monthly payments may result in the repossession of the property by the seller and a forfeiture of any payments collected as rent on the land. Repossession is reserved as a last resort after we have made multiple attempts to help bring account holders current.

We work hard to help bring our account holders current and offer much more leniency than you’d expect from a bank or traditional lender. We have a mutual goal of making you a land owner and will work with you to make that possible.

Title by Deed

All properties purchased using our financing will be sold under a contract for deed and title to each property will not be conveyed to buyer(s) until the balance on the property is paid in full including any payments due for taxes, property dues, late fees, or fees associated with ownership of the property. Unless otherwise specified in the buyer's real estate purchase agreement, deeds conveying title from seller to buyer(s) shall be recorded without the benefit of independent escrow or title insurance. Escrow for title transfer and title insurance is available at the buyer's expense.

Taxes and Dues for Properties Purchase with Financing

Reimbursement of yearly property taxes, processing fees, homeowner's or property owner’s association fees, and any fees associated with property ownership shall be paid by the buyer(s) and will be added to buyer’s account balance while the property remains in our name under the contract for deed arrangement. We the seller will initially pay all yearly taxes, dues, and fees associated with the property and it is then the responsibility of the buyer(s) to reimburse us for these payments. Buyers have one full year to make reimbursements for taxes and dues and reimbursement payments can be made to us in one full annual payment or split into 2 bi-annual payments. Once the property is paid in full and ownership is transferred it will be the sole responsibility of the new owner to make any and all of these payments on their own.

Property taxes and property dues which are due and payable prior to the date when the property is purchased shall be paid by seller.

Typographical Errors

In the event a property is listed at an incorrect price or with incorrect information due to a typographical error or error in pricing, availability, or property information received from counties or property data sources, we shall have the right to refuse or cancel the sale of that product. We have the right to refuse or cancel any such purchase whether or not the purchase has been confirmed and/or payment has been made. If your credit card has been charged or you have already sent payment and your purchase is cancelled, we shall immediately refund your money, issue a credit to your card, or send back or refund any other forms of payments.
